  On September 17, 2007, we provided an analysis of The Employment Non-Discrimination Act (ENDA), introduced as H.R. 2015, and the significant legal implications its provisions would create for all employers.

  The Employment Non-Discrimination Act, S. 1284 (ENDA) was re-introduced in the Senate on July 31, 2001. It has been introduced in various forms over the past six years by Senator Ted Kennedy (D-MA) and Senator Jim Jeffords (I-VT). A House version has been offered by Rep. Barney Frank (D-MA).

  This legislation will amend United States Code dealing with discrimination against federal employees by adding “sexual orientation” to 5 U.S.C. § 2302(b)(10). Yet, “sexual orientation” is not defined either in this legislation or in federal law generally.
