Kosilek sued the prison system in 2000 claiming that refusing to permit him to have a sex change operation is cruel and unusual punishment.

He is now complaining: “My breasts have shrunk, genitals have regained previous size and function, facial hair is thicker and scalp hair is thinner, all related to an elevated testosterone level.”
A trial over his lawsuit was conducted from May 2006 to March 2007. During that time, health care experts testified to the tune of $52,000 in consulting fees. A sex change operation would cost the taxpayers of Massachusetts $20,000.

The Department of Corrections said a sex change operation would create a nightmare for security personnel. Kosilek could become a target of sexual assault.

Kosilek’s attorney claims that a sex change operation for him is medical necessity.

“The Associated Press story on Kosilek is promoting the fiction that he’s already a woman even though he is anatomically a male,” said TVC Executive Director Andrea Lafferty. “This sex change nonsense must stop – and the mainstream media must desist from perpetuating these fictions about ‘gender identity’ to the American people. This brutal murderer is mentally disordered and needs therapy, not mutilating surgery so he can pretend to be a woman. No one can change their sex. He deserves death for what he did to his wife, not coddling.”
