Washington Supreme Court Upholds Traditional Marriage!
July 27, 2006 – On July 26, the Supreme Court of Washington state issued a decision ruling that the legislature had the right to define marriage as a union of one man and one woman. The state’s Defense of Marriage Act (DOMA) had been challenged by homosexual activists as being unconstitutional. The Court ruled against the homosexual activist movement. The Court noted: The two cases before us require us to decide whether the legislature has the power to limit marriage in Washington State to opposite-sex couples. The state constitution and controlling case law compel us to answer ‘yes,’ and we therefore reverse the trial courts.”The Court ruling—both the majority and minority opinions can be accessed here: http://www.courts.wa.gov/newsinfo/?fa=newsinfo.internetdetail&newsid=707
TVC issued a press release on this case on July 26. The release is reprinted below:
Washington Supreme Court Upholds Traditional Marriage!
Washington, DC – “Today’s decision by the Washington State Supreme Court in upholding traditional marriage is welcome news to us,” said Traditional Values Coalition Chairman Rev. Louis P. Sheldon today. “The Court correctly ruled that the people and state legislature have the right to define marriage as a one-man, one-woman union.”
“It looks like the ‘homosexual marriage’ Goliath is having its head cut off by rational rulings by state courts all over the U.S.,” said Rev. Sheldon. “This makes the 7th decision in recent weeks that has upheld the right of the people to define marriage as a one-man, one-woman union.
“It is my hope that the people of Massachusetts will be given the opportunity to vote against same-sex marriage in 2008 if an amendment is on the ballot. The state legislature must do the right thing and permit the people to vote on this important issue.”
The Washington Court ruled in a 5-4 decision that the state legislature is exercising its constitutional right in passing a Defense of Marriage Act to prohibit same-sex marriages in the state.
“Despite the efforts of radical homosexual activists to redefine marriage, we are seeing a backlash from state court judges who are refusing to overrule the will of the people on this issue. We are winning this battle, one state at a time.
“While we are pleased with this ruling, the definition of marriage is still at risk in several states. Therefore, Congress must pass a constitutional amendment that fully protects marriage without granting the right to homosexual civil unions, domestic partnerships or any other counterfeit of traditional marriage,” said Rev. Sheldon.
