New Report Details 9 th Circuit Court Attack On Parental Rights

November 10, 2005 -- The radical leftist 9 th Circuit Court of Appeals in San Francisco has dealt a blow to parental rights in a recent decision. On November 2, 2005, a three-judge panel, headed by Judge Stephen Reinhardt, issued an edict that undermines parental authority over what children are taught about sex in public schools.The panel’s decision in Fields v. Palmdale School District,rejected a lawsuit brought by parents against the school district. The parents claimed that their rights had been violated by the school district in distributing a sexually provocative survey to children in the first, third, and fifth grades.

The survey had asked children to answer whether or not they had felt like touching their private parts or other individual’s private parts and other invasive questions.

The writer of the survey had sent a letter to parents asking them for permission to give the questionnaire to children—but never mentioned the explicit nature of some of the questions.

The three-judge panel rejected parental concerns. In writing his opinion, Reinhardt stated: “We … hold that there is no fundamental right of parents to be the exclusive provider of information regarding sexual matters to their children…”

If this decision is not overturned on appeal, it will seriously undermine the right of parents to protect their children from sexually explicit and immoral sex education materials in the public schools.

Judge Reinhardt is notorious for issuing amoral and extra-constitutional decisions based upon his liberal ideology. He is the judge who issued the 9 th Circuit opinion in 2002 declaring that the Pledge of Allegiance is unconstitutional. His wife is Ramona Ripston, head of the ACLU for Southern California.
